Copy of Motion to Quash Arrest Warrant
Mary Lacy is about 15 minutes away from a news conference in which she undoubtabley be skewered by the press. In the meantime here is a copy of the Motion to Quash Arrest Warrant
Released? Well not quite.
Contrary to what I reported in my previous post, John Mark Karr is not a free man. The reason is he is working on his frequent flyer miles between Colorado and California. There is that little pesky matter of the child porn charges in California from which he ran and skipped bond. So now, the shoe is on the other foot with Cali waiting for him to be released into their custody. Freaky deaky.
Charges Dropped!
Well, I can't say that I didn't expect this but not this soon. John Mark Karr was released from jail today at 3:04 PM when Mary Lacy's office decided not to press charges and the case against him has been dropped. I mean holy shit, how much more screwed up can this case be? The reason he was released is that his DNA didn't match the blood spatter found in JonBenet's underwear.
The fact that they dropped the charges, in my estimation makes Mary Lacy's office look like a bunch of bumbling fools that can't figure anything out. The next press release from her office might as well be it was Professor Plumb in the study with the candlestick. So let's see what we have here. An absolute media feeding frenzy, a lightning fast rush to judegement with no facts, a free trip to the U.S. complete with prawns and champagne, all at the Colorado taxpayers' expense. Seems like political suicide to me.
Ms. Lacy tried defending her actions by making the following statement.
"As I said last week, our role in the investigation of JonBenet Ramsey's murder has been to follow up on all legitimate leads that we have received from law enforcement and concerned citizens," her statement read. "This case is not closed, and we will continue to investigate leads and pursue justice."
Translation: I fucked up and now I am in heavy duty spin mode. Too late, Ms. Lacy. Perhaps you should drag that garrote out of the evidence locker and wrap it firmly around your political career.
Seth Temin, the public defender who represented Mr. Karr had the following no so flattering comments to make.
"We're deeply distressed by the fact that they took this man and dragged him here from Bangkok, Thailand, with no forensic evidence confirming the allegations against him and no independent factors leading to a presumption that he did anything wrong," Temin said.
Both the Boulder Sherriff's department and the Boulder District Attorney's office have news conferences scheduled. As soon as the information from those respective news conferences are available, you'll see it here.
What's Up Next?
Well the war of the attorneys seems to be over and the Boulder PD's office has come out the "winner". Ms. Harmon will have to get her 15 minutes elsewhere.
Today's hearing at 4:30 PM MST is going to be what is called an "Advisory Hearing" at which John Mark Karr will be advised of his rights. The judge will then set another hearing date, possibly as early as Thursday at which time the Boulder DA Mary Lacy could or could not charge Karr in the crimes. Confused? Me too.
The Apple And The Tree
Well, I'm kinda bushed after doing that last post but I wanted to get this out there as well. So I'm going to give my opinion on this matter and then give links to two stories.
It seems puzzling to me that a family who, until last week, thought that John Mark Karr was dead is now so involved in getting their 15 minutes. Not only didn't they know if he ws dead or alive, they made no effort to confirm either scenario.
They claim to have his best interests at heart and that of his sons but as these two articles show, they seem as full of shit as John Mark Karr himself. You read them and be the judge. I'm off to have a few beers. Cheers!

If you ask me, their appearance on Good Morning America made them seem like real goobers. So I guess the apple doesn't really far from the tree after all.
Who's The Boss?
I suppose that it was inevitable that it would come to this. I saw it happenig in California with Ms. Harmon and Ms. Van Zandt. Now all the rats are fighting over the Karr piece of cheese. Harmon and Van Zandt got their hooks into him in California and they alledgedly have a contract to represent him in Colorado. Only problem is Harmon and Van Zandt need an "in" in Colorado. They need to have an attorney "sponsor" them in Colorado for this one case so that legally, their status as attorneys will be recognized in Colorado. Enter Rachel Cohen, a 29 year old Lafayette, Colorado woman who has only been an attorney since October of 2005.
Her choice as co-counsel seems curious at best, considering her lack of experience. But she is the one who contacted Harmon to be involved in the case which makes this bizarre case even more bizarre. Cohen, who works out of her home in Lafayette and has been a member of the Colorado Bar Association since October, said she initiated contact with Harmon to inquire about joining the case.
"I'm a younger attorney in town, and I had been following the case since it came back into the public light," said Cohen, who turns 30 next month. She is also pregnant and is due in January.
Cohen's entrance into the Ramsey case raised eyebrows on a number of veteran lawyers in the Boulder area. Denver defense lawyer and legal analyst Scott Robinson responded: "Rachel Cohen?"
Upon being briefed, Robinson said, "It's a volunteer virtual unknown deferring to volunteer virtual unknowns in a case where all three of them have injected themselves into a high-profile case. It's like a first-year intern doing a heart transplant."
And for whatever reason it seems to be an important factor that Cohen is a female.
"I like her passion," Harmon said of Cohen. "I like her intelligence. She's very experienced, even though she hasn't been a lawyer very long."
"She is a passionate little defender, and she's female, which is very important." Harmon wouldn't say why Cohen's gender is important. However, in cases involving alleged sexual assault by a male defendant, it is often seen as an advantage for the defendant to be seen in close company with a woman - think accused basketball star Kobe Bryant and local hotshot attorney Pamela Mackey - so as to make him seem less dangerous in the eyes of jurors. I don't see how that is possible given the absurdity of Karr and his actions in this case. But whatever..
Meanwhile the public defenders office seems to be doing a very credible job so far in Karr's defense. Office head and Deputy Public Defender Seth Temlin is a man possessed in his defense of Karr. He filed a flurry of breifs on Friday in the case. Two of the motions were key to get possible previous evidence excluded from the case.
The first of the two key motions was to halt DNA testing until the defense is notified of its purpose. The defense also argued that any previous collection of Karr's DNA would be illegally gained. Boulder District Judge Roxanne Bailin has not ruled.
Meanwhile, the Denver police lab confirmed Friday it has been asked to analyze DNA from Karr to see whether there is a match from fluid found on the underwear of JonBenet.
Karr was given a mouth-swab DNA test while he was in Thailand, a law enforcement official who spoke on condition of anonymity because of the ongoing investigation has told The Associated Press. The results of that test were not known.
Temin said if a DNA sample has been obtained from Karr "it was not obtained pursuant to applicable law, the constitutions or by valid consent." He suggested Karr would not provide any further samples without a court order.
"Biological evidence reveals highly private and sensitive information about a person," Temin wrote. "Mr. Karr's right to privacy can only be protected by giving him the opportunity to be heard on this issue prior to collection of a sample."
The second motion was suppress any handwriting from the public in the fear that it might taint a possible jury pool. He seems like a sharp guy, whereas Team Cali seems to fighting for scraps of meat. And it also seems that feathers are being ruffled between the two competing attorneys.
Now this is where it gets good. There is nothing better than a good old cat fight between attorneys, even if one them is a male.
"We are Mr. Karr's attorneys at this point," Temin said. "If he hires somebody else of his choosing who is a qualified Colorado attorney, that's up to him."
"My team is the Colorado State Public Defender's Office," Seth Temin said outside the county jail. "There will be no other attorneys that are not part of the public defender's system on this case."
But the two California lawyers, Patience Van Zandt and Jamie Harmon, say they're Karr's counsel. Told shortly after landing in Denver late Friday that the public defender said that Harmon and Van Zandt were off the case, Harmon said, "They can do whatever they want."
Asked if she believed that her involvement is over, Harmon said, "I can't talk about any of that."
She then added: "I talked to my client at 11 a.m., and I'm on my way to see him now."
This is the way I see things. It appears that Mr. Temin, toiling away on a civil servant's wages seems to have his clients best interests at heart. Whether or not we think John Mark Karr killed JonBenet Ramsey, I think that we have seen and heard enough about him to form an opinion. My opinion is that he is a repugnant little pedophile slug. But hey, that's just me. However, regardless of what I or you might think about him, our Constitution guarantees him a defense and as I said it appears as though Temin is serving his client's best interests.
Whereas Team Cali seems to want to make a name for themselves and are using this case as their conduit to achieve that goal. Ms. Harmon is hellbent on making a name for herself even if it means stepping on poor Ms. Cohen and more reprehensibly John Mark Karr. Let's take a look at some of her comments.
With respect to Ms. Cohen:
"She's going to assist us in any way she can, and she's going to help me get admitted (to the Colorado Bar Association)," said Harmon.
Harmon said it is not her intent to "brush her aside" and not allow Cohen a meaningful role in the case. However, she also said, "I've been an attorney for a long time, and I'm pretty good at it. She (Cohen) is completely aware of my experience levels. I have no intention of pushing her side, and she can be involved to the extent that she wants to be."
"Just because I don't know the specifics of your legal system in Colorado - and believe me I've been learning a lot more about it in the last 24 hours - that doesn't mean I'm going to let you take over. That's not going to happen."
And, she said, "I'm going to be the captain of the ship, and I don't think there's any question about that with anybody."
Doesn't exactly sound like a team player to me, more like Captain Kidd. Or perhaps even Captain Kangaroo. Those statements seem to me to sound more like someone who has their own best interests at heart and damn anyone who gets in her way.
Honestly it sounds to me like she wants to be the next Johnnie Cochran.
The one thing that we do know is who the attorneys for the prosecutors office will be:
The Boulder District Attorney's Office announced that assistant district attorneys Peter Maguire and Bill Nagel and investigator Tom Bennett would head the prosecution effort, along with District Attorney Mary Lacy.
The other legal manueverings on Friday were:
• Judge Roxanne Bailin, citing overwhelming publicity, issued a gag order that prohibits lawyers on either side from making comments that would harm the chances of a fair trial.
The lawyers can make no comments on Karr's character, his likelihood of guilt or on whether he failed or passed any tests, including DNA tests.
• Temin and the defense team asked that an application for indigency status for Karr be sealed, saying it contains his handwriting. If that sample were compared with the ransom note before trial, it could prejudice a fair trial, Temin said.
• The public defender asked for copies of all notes, investigative reports and other documents compiled by the prosecution.
Cobwebs Are Winning
I am working on a new post. I am in the research phase right now and honestly there is so much information out there that I am just collecting it right now as I drink my coffee and try to shake off the cobwebs of last night. As soon as I can put all the information into a lucid format I'll have it up here. Thanks for your patience.
My head, it shacks!
Take a look at all the legal shit that went down today in this case. It's a mountain of motions and paperwork. Oh and by the way, John Mark Karr's first court appearance in a Boulder courtroom is scheduled for Monday at approximately 4:00 PM EST.
This is where John Mark Karr will be on Monday.
I Found It
I found the Colorado Judicial Branch website that has all the pertinent information about court appearances, etc. Also of note, he has been assigned a public defender until Ms. Harmon and Ms. Van Zandt apply to the state of Colorado to be able to defend him for this case. Here is the link to the Colorado Judicial Branch website.
The Waiting Is The Hardest Part
Not too much to report right now. No one is sure when he will appear in front of a judge to face the charges of murder, kidnapping and sexual assault of a minor. Could be today, tomorrow or Monday. I'm trying to track down the website where the court docket will be put up with his name on it that will show when he will be due in court. What I do have is his booking report and three press releases from the Boulder County Sheriff's Department about the case.
Statement one.Statement two.Statement three.I added a new feature. Now you can sign up for instant email updates any time that I put something new up here. The box is on the right. Simply put in your email address, confirm your address and you are subscribed.
Plane Just Went Airborne
The plane just took off on its way to Boulder. Once again, his first court appearance is scheduled for tomorrow and that is when the 72 hour clock starts ticking for Mary Lacy to be able to charge him.
He Just Boarded The Plane
I just watched him being unshackled by the LASD and being re-shackled by Colorado law enforcement. He was then escorted up the short ramp and into the plane without incident. The plane is taxiing right now. The right engine just started and now the left engine is coming to life. He is scheduled to arrive at the Boulder County Airport sometime around 7:00 PM EST tonight where he will be transported to the Boulder County Jail. His first appearance is scheduled for tomorrow. Remember no cameras tomorrow.
He's On The Move
According to MSNBC the plane that landed in Long Beach, California a little over an hour ago will be leaving at 4:00PM EST with John Mark Karr onboard headed for Boulder, Colorado. The story is being confirmed by KNBC-TV in Los Angeles. If you click on this link you can can scroll down to where it says LIVE VIDEO and click that link on and watch the plane at the airport in Long Beach.
This Just In
According to the Rocky Mountain News, a Colorado State plane (Beechcraft KingAir B200) left Boulder this morning heading for Long Beach, CA. The plane is expected to arrive at 1:00 PM MST in Long Beach. Colorado state authorities are mum on why the plane is heading to California but come on folks, connect the dots.
Specs on the Beechcraft KingAir B200
As soon as I have something more on this development, you'll see it here. The plane just landed at 2:48 PM EST and the Colorado officials are now getting off the plane. There is much speculation (what else is new) as to why they sent a private plane as opposed to shipping him to Colorado on a commercial plane.
Cue Up The Twilight Zone Music - Karr The Wolf
According to an ex-roommate John Hall, Karr bragged about his sexuality saying "sexually, I am like a wolf". Whoa! This guy is not only hung up JonBenet but he is living in the past, re-living fantasies through 80's music.
John Mark Karr bragged to his landlord’s family that "sexually, I am like a wolf" and said he preferred girls to women when he worked in Costa Rica as an English teacher, his former housemates told The Associated Press.
MSNBC has the scoopage.
New Word?
OK, how many times have you heard the following words retched up by a talking head during this John Mark Karr case? Curiouser and curiouser. Well according to dictionary.com there is no such word. If this thing plays out as long as the O.J. debacle, I guarantee you that it will be added to our lexicon.
DId Mary Lacy Screw Up?
Why hasn't John Mark Karr been sent to Boulder yet? Lots of specualtion, but what I do know is that Boulder investigators have been interviewing Karr family members, both in Georgia and Alabama at a furious pace over the past two days.
That leaves me to the conclusion that the only reason his creepy ass isn't in a Boulder court room today is that Boulder District Attorney Mary Lacy is still building her case. If she brings him to Boulder now, she has only 72 hours to charge him. My thoughts are is that she doesn't have enough to charge him right at this particular moment. She doesn't want to somehow run into a double jeopardy situation, so she is trying to gather as much evidence as possible before bringing him there.
Which begs the next question. According to all reliable sources, not one law enforcement agency has done a DNA swab yet. Why is that? Are they afraid that it won't be a match and all of this was yet another exercise in futility on the part of law enforcement to try and find a killer in the JonBenet murder?
Tick tock Ms. Lacy.
Two San Jose Lawyers To Represent Karr
In yet another curious twist to this case it appears that Patience Van Zandt, who represented John Mark Karr in 2001 as a member of the Public Defender's Office and her boss, Jamie Harmon will represent John Mark Karr once he gets to Colorado, which isn't expected to happen until some time next week.
What makes this so strange is that Harmon & Assocaites is a small three person law firm from San Jose, California. Not exactly the high powered type of law firm that one might expect in this colossal type of case. Speculation is running rampant in the legal community as to why these two women would take on such a case of magnamimous proportions.
"Any lawyer that would get that close to that circus would have to be out of his mind," said James McManis, of Manis Faulkner & Morgan, one of San Jose's most prominent law firms. "I think it peculiar some San Jose attorney would hold a press conference in Los Angeles on this brief stop-over Mr. Karr is making en route from Thailand to Boulder, Colorado. I think it's just bizarre."
And it seems as though one of the attorneys, Jamie Harmon has some baggage of her own. In a series of articles published earlier this year, the San Jose Mercury did a piece on Harmon questioning her legal advice.
Harmon, 49, had been cited by judges on three occasions for giving incorrect legal advice to clients, isolated instances that Harmon has said are not illustrative of a 23-year career that has involved hundreds of cases. Wednesday she portrayed herself the victim of a political agenda.
"That series of articles was to further the political agenda of the person who was running for district attorney who has enormous animosity towards me personally and who wanted to use that forum in order to give her animosity some exercise," Harmon said at a news conference Wednesday.
In one case in 2002 involved client Ralph A. Cortez who was charged with sexual molestation. Although he maintained his innocence, he agreed to plead no contest based on Harmon's counsel. He later changed his mind and declared Harmon's advice was wrong.
As proof, he submitted a secret tape recording -- made weeks after his plea -- in which Harmon is heard telling Cortez he could petition to have his name expunged from the state's sex offender registry. In reality, Cortez would have had to apply after a 10-year period and hope for a governor's pardon.
After hearing the tape, Judge Edward Lee allowed Cortez to withdraw his plea, but not before saying, "There is something in this case that simply stinks."
Is Harmon and her little three person law firm up to the task? That remains to be seen.
Chatty Kathy
It seems that suspect John Mark Karr was quite the Chatty Kathy on his ride from the airport in L.A. to the Los Angeles County jail. Among other things he said:
"Everybody says I couldn't know my way around the house, but I got in the house around 5 o'clock ... and I stayed there all night," the source quoted Karr as saying.
He also said:
"they" -- meaning the Ramseys -- did not come home until about 10 p.m. He also repeated what he earlier told reporters -- that JonBenet's death was an accident, and that he was with her when she died.
Karr also told a Thai officer that he had "sex" with JonBenet, who was 6, before her December 26, 1996, death but "there was no penetration," a Thai official said Wednesday.

More Bullshit From Professor Tracy
OK, I admit it. I don't care for this guy. He is a self-serving, pontificating, bombastic asshole. I found this article today. The story came from the Broward-Palm Beach New Times. In the article it says and I quote "While the case against John Mark Karr disintegrates by the minute, New Times has learned that this isn't the first time Colorado University Professor Michael Tracey has caused a stir by fingering a "prime suspect" in the JonBenet Ramsey murder case — only to be proved wrong. I bolded the word wrong. For the full story on our good professor click here.
John Mark Karr Didn't Make The Grade As A Teacher
According to the assistant director of a large private school in Bangkok, John Mark Karr "appeared to be normal". Yeah, well appearances can be decieving. I guess they have a pretty low threshold of what a "normal" person is in Thailand. Here is the full report of John Mark Karr's checkered teaching past.
12 Year Karr Bride Speaks
Quientana Ray, who was 12 years old at the time of her marriage to John Mark Karr appeared on the ABC morning show Good Morning America today. During the interview she had lots to say. Including 'He Had Fantasies About Little Girls'. This guy is just sick and gets creepier and creepier the more that information about his sordid life comes out.
When The Bizarre Becomes Surreal
Karr's relatives offer book, movie rights to author/agent.
It was reported today that John Mark Karr's relatives have offered the book and movie rights to author and producer Larry Garrison.
Wexler Karr, father of the John Mark Karr, who, until his arrest thought that his son was dead made the announcement today. What the family is saying is that they are not tryint to profit off of this but to be able to hire an attorney to defend John Mark Karr. I can't wait to see if the lawyers think that this falls under the famous Son Of Sam laws.
The entire premise of the Son of Sam law is that a criminal can not profit from his illegal activity by writing a book, selling movie rights, etc. California's original law was stuck down in 2002. It has been replaced with a similar provsion. Both Colorado and Gerogia (where Karr's family lives), do have Son of Sam laws. A total of 35 states have such laws.
Now getting back to the Karr family and selling the rights you can read all about it here.
